The Regional Trial Court, Branch 44 of Initao, Misamis Oriental ordered last February18, 2015, the transfer of Mayor Celso G. Regencia’s detention from Iligan City Jail to Misamis Oriental Provincial Jail and Rehabilitation in Cagayan de Oro.
The Order signed by Presiding Judge Marissa P. Estabaya stated that the Court resolved to:
1. GRANT the motion for the transfer of detention of accused Celso. G. Regencia from BJMP Tipanoy Iligan to Provincial Jail and Rehabilitation in Cagayan de Oro.
2. To direct the jail warden of the Bureau of Jail Management Penology in Tipanoy, Iligan City to effect the immediate transfer of custody of accused Celso Regencia from his detention place at the BJMP at Tipanoy, Iligan City to the detention facility at the MOPJR (Misamis Oriental Provincial Jail and Rehabilitation) and to ensure that necessary safety and security measures be undertaken.
3. To direct the jail warden of BJMP Tipanoy, Iligan to submit compliance report within ten (10) days from the effect of transfer of accused CELSO G. REGENCIA.
Among the reasons stated for the said transfer is that there are available detention facilities within the region such as BJMP Initao District jail and MOPJR (Misamis Oriental Provincial Jail and Rehabilitation. Hence, the Court finds no valid justification to continue with the detention of the accused in a facility outside the area of supervision of the presiding judge.
Meanwhile as of 6 o’clock on March 8, Regencia was said to be still in the BJMP Tipanoy, Iligan and that his supporters have barricaded the gate of the said jail to block his transfer to MOPJR. – The New Ranao Star -
