Although the Court of Appeals has affirmed the compulsory retirement of Macatanong through its decision for C.A. GP SP No. 06266 MIN her position could still not be considered vacant, the letter stated.

The letter continued, “Macatanong has still fifteen days to submit her motion for reconsideration or appeal with the Court of Appeals.”
